The moment they did this, Stardock was legally obliged to get them to back off to protect their ownership of the mark. Huuuh, I'm not familiar with that legal theory. Could you offer some sort of citation? I would have thought the original games already created a connection between the lore and the tradema

I think the issue you are having is that you don't actually understand the concept of a trademark.
I find the UQM community arguments amusing because the parallel argument would be that anyone can 100% copy every element that is associated with a trademarked good and it is perfectly acceptable as long as you don't label the good with the mark. What value would trademarks have if this was accurate? I'm 100% certain if the UQM community were instead an entity selling that game, they would have received a C&D within days from Atari/Accolate followed immediately by an infringement
For the rest (P&F's potential infringement of the "Star Control" mark itself, and any copyright issues), I'm content to let the chips fall where they may, and really just want to try to understand them as they're dropping.
If this were true you and your cohorts wouldn't be quoting Wikipedia articles and using the content to accuse Stardock of wrongdoing

Just as an idea of what Elestan, Lakstoties, and the other lackeys are posting elsewhere. Again guys and gals, this isn't Stardock's interpretation of the law. Stardock has counsel who has spent his entire career in this field. You are delusional for believing a layman googling and reading Wikipedia knows better than a top-IP law firm partner.
Quoting Taslios, reply 362 that's sorta kinda exactly my point.... without knowing the contracts and the details all of any of this is raw speculation. Ah, but in this case, we do have the contract involved. Most of the talk is still speculation, of course; just a little bit less raw. so care to answer my previous question as to why you are so adamant about seeing things as thoug
I don't think Paul and Fred can compromise on this point, because it would mean that they couldn't return to the UQM universe without Stardock's permission, and they view that universe as their baby. IMHO, Stardock could still make plenty of great games without using the SC2 races, so it could yield this point if it wanted to.
I think you are being disingenuous with statements like the above. The only party to t
Brad, I think it is clear that you should just concede defeat and shutter Stardock. Clearly your counsel, who has spent his entire career practicing in this field, has either 1) cow-tailed to your clearly erroneous litigation wishes or 2) is completely incompetent and has committed serious malpractice. Indeed, if desk-jockey attorneys can know without a doubt that your legal positions are untenable, you truly have no chance in this litigation. Elestan, Lakstoties, an
