Freedom of opnion vs. copyright in the Netherlands.

A few years ago someone quoted "copyrighted" work of Scientology on the net in the Netherlands. After 8 years there is a verdict and the freedom of opnion won.

Interesting in this case is that ISPs cannot be hold responsible for the contents of a web site. They just provide the medium, not the contents. Also a hyperlink which points to material that infringes upon a copyright is now ruled not to be the responsibility of the ISPs.

BTW: XS4All (one of the providers in the case) has applied for "Highest number of postponements of a civil law suit" in the Guiness book of records. The judgement in the Scientology case has been postponed for 9 times. Guinness found the application too specific to be incorporated into the book.

This case was very much an international case. Afterall parties came from the Netherlands, Denmark, the UK and the USA. However I doubt if it will have any impact on countries outside the Netherlands. (And it also helps if you can read a bit of German).

The Alien Cult got a bite out of it here in Clearwater over court costs on the Macpherson case.

There will not be any criminal charges from what it looks like but they are going to get popped hard in the Civil Suit whic I hope drains every last penny out of their coffers.

Maybe they will have to sell all the real estate they have acquired, as I have watched them buy up Clearwater for the last 25 years. It would be nice to have the city back.

Well, the Scientology case was not primarily about fighting a cult. The emphasis was on freedom of opnion, protection of users and the role of ISPs in web site content and hyperlinks.

The case in short: years ago certain "top secret" Scientology documents were put online. Scientology went after the ones putting it online, forcing them to take it down. In response a Dutch writer/journalist/whatever put the documents up on her site. Ofcourse, Scientology was not pleased and the big sue-campaign began. Later, she replaced the actual works with quotes (something that might have had an impact on the final verdict).

Correct, 'door' means '(done) by', but also 'through'.
